With the implementation of Aarto (Administrative Adjudication of Road Traffic Offences) regulations around the corner, operators have been advised to take action to familiarise themselves with the regulations and penalties for non-compliance.
The demerit points system is expected to be implemented between April and mid-2025.
This small excerpt from the 495-page Aarto regulations document provides some insight into the severity of the penalties for infringements.
Driving under the influence, for example, exacts significant punitive outcomes for both company and driver.
Companies are now made responsible for their drivers should they be over the legal limit while driving company vehicles.
The penalties against both driver and company are dire:
- Drivers - When convicted, drivers could incur a possible R5 000.00 fine, a criminal conviction, possible imprisonment, six demerit points, and will not be able to renew their PrDPs.
- If the company is found guilty - R5 000.00 fine, six demerit points against that vehicle licence, and only once the case in court has been finalised will the vehicle be released from the pound.
