On 10 September 2021, the International Trade Administration Commission (ITAC) published its 19-page “Amended Guidelines and Conditions Relating to Extension of Safeguard Measures”.
The purpose of the guidelines is to provide a reference and procedural guide pertaining to the application for an extension of safeguard measures.
The scope of the guidelines covers the application process by applicants for an extension of safeguard measures, which provides that a definitive measure may be extended by a period of up to six years where ITAC finds that: (a) the lapse of the safeguard measure is likely to lead to the recurrence of serious injury; and (b) there is evidence that the Southern African Customs Union (SACU) industry is adjusting.
The guidelines require that ITAC shall provide country representatives that have a substantial interest in a general safeguard investigation 30 days for consultations prior to the application or extension of a definitive measure.
