On 19 April 2024, the International Trade Administration Commission of South Africa (ITAC) extended an invitation for comment on its Sunset Review of the anti-dumping duties on garden picks, spades and shovels, rakes and forks, classifiable in tariff subheadings 8201.10.05, 8201.10.10, 8201.30.03, 8201.30.90 and 8201.90.20 originating in or imported from the People’s Republic of China. Comment is due by 19 May 2024.
The application was lodged by Lasher Tools being the major producer in the Southern African Customs Union (SACU) Industry by production volume, supported by MacCorkindale Investments (Pty) Ltd and Ottimo Products CC; thus ITAC regarded the application as “made by or on behalf” of the SACU Industry.
The allegation of the likelihood of the recurrence of dumping is based on the comparison between the normal values and the export prices should the anti-dumping duties expire.
After considering the submission it found that there was prima facie proof of the likelihood of the continuation of material injury if the anti-dumping duties expire.
