On 20 August 2021, the International Trade Administration Commission of South Africa (ITAC) announced the release of its 19-page “Amended Guidelines and Conditions Relating to Extension of Safeguard Measures”.
According to the Guideline its purpose is to provide a reference and procedural guide pertaining to the application for an extension of safeguard measures in terms of Amended Safeguard Regulation.
The Scope of the Guidelines covers the application process by applicants for an extension of safeguard measures, which provides that a definitive measure may be extended by a period of up to six (6) years where ITAC finds that: (a) The lapse of the safeguard measure imposed in terms of subsection 6 is likely to lead to the recurrence of serious injury; and (b) There is evidence that the Southern African Customs Union (SACU) industry is adjusting.
